RIGHT TO RETRACTATION

  1. General

The consumer has a right of withdrawal, in accordance with the regulations on distance selling (RVD). The right of withdrawal gives the consumer the opportunity to terminate the contract of sale within thirty (30) days after delivery if he is not satisfied with the product. No obligation of motivation or penalty is required. However, BEGUMMY invites you to share your comments in order to improve its services.

If the consumer exercises his right of withdrawal in accordance with the legal conditions, BEGUMMY will reimburse him the amount actually paid for the product within thirty (30) calendar days. This rule also applies to orders placed on the occasion of promotional offers. The consumer will receive a voucher of a value equal to the amount of the original order, with the exception of the delivery and return costs. The consumer always has the right to refuse the purchase voucher and to request a refund. In this case, the consumer will receive a refund equivalent to the total value of the order, with the exception of the delivery and return costs. The refund will be made using the same method of payment as the one used for the original transaction, unless you have expressly given your consent for another method of payment.

No additional charges will be charged for the refund.

BEGUMMY does not reimburse additional shipping costs, such as the costs incurred by a delivery method other than the cheapest standard delivery method. 

  1. Exceptions to the right of withdrawal

The consumer is not authorised to exercise his right of withdrawal in the following cases:

  • The supply of goods which are manufactured according to the consumer's specifications or which are clearly personalised;
  • The supply of goods likely to deteriorate or expire rapidly;
  • The supply of sealed goods that are not intended to be returned for reasons of health or hygiene protection and which have been unsealed after delivery.
  1. How to exercise your right of withdrawal?

Please note that you may not exercise your right of withdrawal in accordance with the RVD unless you notify us formally in writing within thirty (30) days of receipt of your order. The notification of withdrawal must be sent by e-mail to info@begummy.com or by mail to the customer service, BEGUMMY, Boulevard de l'Europe 127.1301 Bierges (Wavre), Belgium.

The following information must always be clearly communicated:

  • Date of order, date of receipt and date on which the right of withdrawal is exercised;
  • Name and address of the consumer;
  • Signature of the consumer.

  1. How to return a product following the exercise of your right of withdrawal?

The consumer who wishes to exercise his right of withdrawal must return the products delivered to the following address: BEGUMMY, Boulevard de l'Europe 127.1301 Bierges (Wavre), Belgium. Products must be returned from the original destination country.

All products must be returned unused, in their original condition, in their original packaging and with all BEGUMMY labels still attached. Items returned damaged or soiled cannot be returned and will be returned to the consumer and/or a refund will be refused. When supplied, the returned items must be fitted with straps and other branded packaging, including authenticity cards, protective bags and leather labels.

The consumer is responsible for any depreciation of the products resulting from their manipulation beyond what is necessary to establish the nature, characteristics and functioning of the products. BEGUMMY is entitled to impute to the consumer the costs of the depreciation on a pro rata basis. This, however, only after BEGUMMY has repaid the original purchase price to the consumer.

The consumer must return the product by means of safe transport to ensure that the product arrives in good condition. We strongly recommend that you insure your shipment to the extent that you are responsible for the condition of the items and will be held responsible for any damage caused to the items until they arrive at our warehouse. In case of litigation, we also recommend that you keep proof of shipment.
 

LEGAL WARRANTY 

  1. General

Each Consumer has a legal warranty period of two (2) years. The consumer may enforce the legal guarantee if the products delivered do not correspond to the product requested or ordered (non-conformity), insofar as the customer has not been able to establish this non-compliance at the time of receipt of the product.

  • If the product is defective within the first six months after delivery, there will be a presumption that the defect existed since the delivery. BEGUMMY can prove otherwise.
  • If the defect of the product is detected more than six months after delivery, the consumer must prove the product's non-compliance at the time of delivery.

The legal warranty is not applicable in the event of damage caused by normal wear and tear, accidental or intentional modifications made to the product by the customer, including improper and improper use, exposure to moisture, fire, earthquake or other external causes.

Additional trade guarantees are always possible in accordance with the General conditions and are always communicated expressly.

  1. Complaint mechanism

The customer or the third party designated by the customer is obliged to verify the conformity of the products at the time of delivery. If the product is affected by a visible defect, and the recipient finds this defect, it is required to file a claim. 

The customer shall communicate these claims to BEGUMMY in writing and in an explicit, unambiguous and reasoned manner. This must be done within three (3) calendar days following delivery to the customer or to the third party designated by the customer. It is the client's duty to sufficiently motivate this communication. In the absence of (sufficiently) reasoned complaint, the customer is not authorized to return the products.

  1. How do I return a product by playing the legal guarantee?

Each customer is obliged to return the product not conforming to BEGUMMY within thirty (30) calendar days following the filing of the claim for repair, replacement or reimbursement. If this is not the case, the suspension of the legal warranty period will be considered void.

The thirty (30) calendar day period shall not apply where it is clearly demonstrated that the product is damaged as a result of the transport. In this case, the customer must return the product without delay and at the latest within three (3) calendar days.

The products must be returned to BEGUMMY in their original condition, including their packaging, accessories and documentation, and always accompanied by the original invoice or valid proof of payment. Any breach of this obligation will result in a proportionate reduction of the reimbursement.

The return of a product is always at the customer's risk. All return costs are borne by BEGUMMY, if the customer complies with the warranty conditions. BEGUMMY will provide the customer with a return slip. In any case, we recommend a return by registered and insured in order to avoid the risk of loss or theft. This return must be made within seven (7) calendar days following the communication. 

  1. Repair or replacement

If the above conditions are fulfilled, the customer is entitled in the first place to the repair or the free replacement of the ordered products, if the situation permits. Please note that we will only replace the product with the same item of the same size, depending on the inventory available. If the product cannot be repaired or if the same product is not available, the customer will receive a voucher of a value equal to the amount of the original order. The customer always has the right to refuse the voucher and to demand a full refund.

BEGUMMY is only liable for reimbursement if the repair or replacement does not confer the same benefit to the customer as the original purchase. The client shall communicate this reason in a clear and reasoned manner. In no event shall any indemnification or reimbursement exceed the amount invoiced to the customer.

If the products were returned while the conditions were not met, BEGUMMY will send them back to the customer. The cost of this shipment will be borne by the customer. BEGUMMY will be able to store the returned products for the account and at the risk of the customer, as long as the return costs have not been paid.
